By accessing and using the Avanti Data platform, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

Scope:

• These terms apply to all users of the Avanti Data platform

• Additional terms may apply to specific features or services

2. Use of the Platform

You agree to use the Avanti Data platform only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

Prohibited Activities:

• Attempting to gain unauthorized access to the platform or other users' accounts

• Using the platform to transmit malware or malicious code

• Reverse engineering or attempting to extract source code

• Excessive API usage that impacts platform performance

3. Data Ownership and Privacy

You retain full ownership of all data you upload, create, or store on the Avanti Data platform. We do not claim any rights to your business data. Your data is stored securely and handled in accordance with our Privacy Policy and applicable data protection regulations including GDPR.

Your Rights:

• You own all data you input into the platform

• You can export your data at any time

• You can request deletion of your data upon account termination

4. Subscription and Billing

Avanti Data is offered as a subscription service with various pricing tiers. Subscriptions automatically renew unless canceled before the renewal date. You will be notified before each renewal with an option to cancel.

Payment Terms:

• Subscriptions are billed monthly or annually based on your selection

• All fees are exclusive of applicable taxes

• Cancellation takes effect at the end of the current billing period

• Refunds are provided in accordance with our refund policy

5. Service Availability

We strive to provide 99.9% uptime for the Avanti Data platform. However, we do not guarantee uninterrupted access and reserve the right to perform scheduled maintenance. We will provide advance notice of planned maintenance when possible.

Disclaimer:

• Service interruptions may occur for maintenance or technical issues

• We are not liable for service disruptions beyond our control

6. Intellectual Property

The Avanti Data platform, including all software, designs, and content, is protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without explicit permission.

License:

• We grant you a limited, non-exclusive license to use the platform

• This license terminates upon cancellation of your subscription

7. Limitation of Liability

Avanti Data is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount you paid for the service in the past 12 months.

8. Changes to Terms

We may modify these Terms and Conditions at any time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the new terms.

9. Termination

Either party may terminate the service agreement at any time. Upon termination, you will retain access until the end of your current billing period. We reserve the right to terminate accounts that violate these terms immediately.

10. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands.
